Question

Asked 7/19/2010

Got a letter from bank. my landlord foreclosed on her house while i was living in it.

I got a letter from bank i will have 90 days to move. my landlord was not paying her morg. payments the whole time i was paying her rent so they foreclosed on the house. also on several occasions i called her about water damage when it would rain heavy the basement leaked. it actually completely flooded once. she bought a humidifier and was supposed to have it fixed. left neglected by the landlord there is mold growing all around the baseboards and going up the basement wall. bank told me would have to get deposit from landlord. the landlord did not even give me a call to let me know what was going on and now will not return any of my phone call. is there anything i can do to get any of my money back or anything legally. i have never been screwed like this. any insight from anyone

You cannot get your past rent back. You lived there and were under contract to pay so that's gone. Hopefully the bank will get your deposit back. If not, you can possibly take her to small claims court for the deposit. Just remember, if she isn't paying her mortgage, it's doubtful she has the money to pay you. Good luck and best wishes.

You might find out if she owns any other property. It should be easy get a judgment in your favor for your deposit by showing him your lease that states the amount of deposit you gave. That does not mean there is anyone to enforce the Judges decision. You can put a lien on any other property she may own. That way you may someday see your money,(both your deposit and court costs) if she should try to sell.
If I may advise you, the next time your in a rental unit and have maintenance issues speak up right away and do not stop until either the problem is fixed or you take her to court.
Just like a prospective renter has to fill out a rental application to see if the owner wants to rent to them, its too bad the renter cant have the landlord fill out and application themselves. That way we could find out if they were someone we wanted to rent from.

I would just start moving and finding another place to live. This kind of stuff is going on all over the country.
