Question

Asked 9/25/2010

Our condo association owes us( a unit owner) over a $1,000. They don't disagree with the amount or respisibility, they just refuse to answer when are we going to get paid.

After a years worth of water damage from old failing stormwindows ruined our wood floor and wall beneath the window, we got our association to agree to make needed repairs to stop water entry. The board had only enough money to replace three of the four stormwindows, we paid for the fourth and the board said they would reimburse us, they refused to pay for floors saying the condos attorney ruled they weren't responsible but they were responsible for wall repair.
We have submitted requests for both repeatedly and asked for a date when we will be paid. It's been 45 days since our last request and have no reply. The email was recieved because the management co. Replyed that day asking the board how do they wish to proceed.

You may have to go to small claims court to get your amount back that you've paid for the fourth window, and it might be a good idea to have an attorney look at your association contract - most of them cover not only four walls, but the floor and ceiling. It shouldn't matter what money is available - usually most associations have to carry insurance to cover these incidences, and an attorney can review the charter and make recommendations on how to best proceed.

Actually they do owe you for the window , as long a condo documents say the association
is responsible for the window , but most condos dont cover the floor covering ,whatever it may be , is up to your homeowners insurance.
